Mr. Nguyen Manh Dzung is a Vietnamese qualified lawyer who has mainly specialised in all types of international dispute resolution in Vietnam including settlement negotiations, litigation before economic and civil courts of major cities of Vietnam and international arbitrations conducted under UNCITRAL, ICC, JCAA, SIAC Rules and Arbitration Rules of Vietnam International Arbitration Center (VIAC) in Vietnam. He has spent over 24 years in the settlement of maritime, commercial and investment disputes by way of international litigation and arbitration in Vietnam and other jurisdictions such as Singapore, Hong Kong, United Kingdom and France.

As an active member of the Drafting Committees on Commercial Arbitration Legislation, Mr. Nguyen Manh Dzung involved closely in the legislative process of the 2010 Law on Commercial Arbitration. Since the enactment of the Law, he has directly commented on its various guiding bye-laws and regulations for the Supreme People’s Court of Vietnam and the Ministry of Justice of Vietnam. Most recently, Mr. Dzung has been appointed as an ADR expert to the Supreme People’s Court in a project sponsored by the UNDP to improve court annexed mediation. Also, he has been officially retained by World Bank to act as a local consultant in advising the Supreme People’s Court to amend the current Civil Procedure Code for promotion of ADR in general and arbitration in particular, including the recognition and enforcement regime.

Mr. Dzung graduated Hanoi University of Law in 1990 and obtained his Master of Law Degree specializing in international commercial dispute resolution from Queen Mary, University of London in 2008. He has been appointed as visiting lecturer on arbitration and mediation at Diplomatic Academy of the Ministry of Foreign Affairs and Judicial Academy of the Ministry of Justice of Vietnam.

 

Arbitration experience:

International Arbitration:

- acting as co-legal counsel to a BVI Company in relation to an investment dispute and parallel proceedings involving a Vietnamese company and a Vietnamese state authority;

- acting as co-legal counsel for a Vietnamese Textile Corporation in a joint venture dispute with an investor before ICC Arbitration with seat in Singapore;

- acting as co-counsel to a Japanese company in several court proceedings against a Vietnamese state authority in relation to a number of ICC arbitrations arising from a very important public infrastructure project;

Domestic Arbitration:

- acting for a group of shareholders against a large Vietnamese joint stock commercial bank in a hybrid dispute resolution process;

- acting for a very famous French invested retailer in a number of VIAC arbitrations on contractual disputes relating to the development of supermarkets in Vietnam;

- acting for a very famous Korean construction corporation in two VIAC arbitrations against a large State-owned commercial bank regarding two construction contracts;

- acting as legal counsel to a foreign invested company in a VIAC arbitration on a construction project against the Malaysian subcontractor;

- acting as legal counsel to a foreign invested company, who was the subcontractor in a major construction project, against the Chinese contractor in the Court of Hanoi City;

- acting for an international investment fund in a VIAC arbitration against a local joint stock company regarding a shareholder dispute;

- acting as legal counsel to global trading companies in relation to sales contract disputes before the VIAC in Hanoi;

- acting as co-legal counsel to a French invested company in relation to a service contract dispute before the VIAC in Hanoi;

- acting as co-legal counsel to several international trading groups in relation to the recognition and enforcement of eleventh foreign arbitral awards of US$ multiple millions in value;

- acting as legal counsel to a BVI Company, operating in Hong Kong, in relation to the recognition and enforcement of a SIAC award of US$ multiple millions in value;

- acting as legal counsel to several Singapore companies in relation to the recognition and enforcement of a number of institutional and ad-hoc arbitral awards;

- acting as legal counsel to a Korean – US partnership in relation to the recognition and enforcement of a SIAC arbitral award; and

- acting as legal counsel to a Russian company in relation to the recognition and enforcement of an ICAC arbitral award.
