Over the course of the past 40 years, arbitration, as an international dispute resolution mechanism, has gained significant global traction. Certain jurisdictions, such as London, Hong Kong, Singapore, Geneva, and New York, are considered arbitration powerhouses, not only for being home to preeminent arbitration firms and boutiques, but also due to the strength of the lex arbitri, and the relevant supporting framework, in promoting these jurisdictions as preferred seats of arbitration.Nevertheless, the role of the UNCITRAL Model Law in harmonising the global arbitration framework, as well as the proactiveness of individual arbitral institutions and the support of the judiciary, has enabled lesser-known jurisdictions, including Vietnam to reposition themselves as emerging centres ready to have a piece of the proverbial โarbitration pieโ.Full interview can be found here:

Vinalines case shows that arbitration law is being ignored in Vietnam
VietNamNet Bridge โ Vinalines and its partners agreed in the past that company disputes could be brought to the Vietnam International Arbitration Center (VIAC), but the shipping firm has not obeyed VIACโs judgment.

Vinalines, the countryโs largest shipping corporation, lost a case brought to VIAC earlier this year, and it was forced to pay VND62.5 billion to the South Korean SK E&C as compensation for breaking a contract for the construction of a harbor at Van Phong transit port in Khanh Hoa province.
Vinalines, which did accept the verdict, petitioned the Hanoi Peopleโs Court, asking the court to annul the verdict. It also asked for the relevant ministriesโ intervention to help speed up the trial of the case.
The Ministry of Transport has sent a dispatch to the Hanoi Court, asking them to try the case soon in order to help ease Vinalinesโ difficulties.
While the Ministry of Transport backs Vinalines, lawyers have criticized the shipping corporationโs behavior.
They cited the Commercial Arbitration Law as saying that Vinalines must respect the judgment of the arbitrators, because it agreed before to have disputes to be arbitrated at VIAC.
โThey (Vinalines) chose VIAC and therefore, it must obey VIAC verdict,โ a lawyer said, emphasizing that the agreement on dispute settlement was a provision of the contract signed between Vinalines and the South Korean partner.
The lawyer went on to say that as Vietnam has become more involved in global trade, its enterprises must respect international laws and practices.
According to Lawyer Nguyen Manh Dung from the London-based Chartered Institute of Arbitrators (CIArb), under the Commercial Arbitration Law, the disputing parties themselves have the right to choose three arbitrators for an arbitration council. One of the arbitrators will be chosen by the plaintiff, the other by the defendant, and the chair of the arbitration council will be chosen by the two arbitrators.
The chosen arbitrators cannot be VIACโs arbitrators. In principle, arbitrators must be independent and objective when considering cases, while no one can intervene in the arbitration councilโs work.
The disputing parties do not have the right to appeal against arbitratorsโ decisions, and therefore, the decisions take effect immediately, not only in Vietnam, but in all the 149 countries which are the members of the 1958 New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards, unless one of the partiesโ petitions the court to annul the arbitratorsโ decisions.
However, Dung said, the court will only annul arbitratorsโ judgments if it finds serious violations of the arbitration proceedings.
The lawyer warned that if the Vietnamese court annuls arbitratorsโ judgments, Vietnamese and foreign businesses will lose confidence in Vietnamese arbitrators and Vietnamese laws.
In fact, Vinalines is not the only Vietnamese enterprise asking the court to abrogate arbitratorsโ decisions. Many similar cases reportedly occurred in the past. As arbitratorsโ decisions are not respected, businesses are hesitating to bring cases to Vietnamese arbitration councils.
